OCI is Seeking Comment on Commercial Lines Modernization
The Office of the Commissioner of Insurance is seeking citizen and stakeholder comments on a proposed rule to exempt certain commercial property rates and forms from filing requirements. Read the notice here.
In summary, the proposed rule will:
- Reduce the premium threshold for the rate filing exemption for coverages for general liability, commercial automobile, crime, and glass from $100,000 to $50,000 (Section 3)
- Create a provision exempting most commercial property and casualty risks developing $50,000 or more in annual premium from rate filing requirements (other than certain coverages) (Section 4)
- Create an exemption for certain commercial property and casualty policy forms from filing requirements subject to premium thresholds of $50,000 or $75,000 based on coverage (Section 5)
- Additional changes to reflect these updates and ensure appropriate oversight, such as record-keeping standards and requiring notice to insureds for exempt forms that have not been reviewed by the Commissioner (Sections 6, 7 & 8).
